Send Text (SMS)

The Send Text (SMS) (Beta) feature offers you the ability to add a ‘Send SMS’ action to your Workflows feature, enabling you to automate the creation and send of SMS communications (the Send Text (SMS) (Beta)).

You agree to pay all applicable fees for use of Send Text (SMS) (Beta), as those may be updated from time to time. We reserve the right to modify pricing at any time. Changes in pricing may result from adjustments made by telecommunications providers or carriers.

You shall use the Send Text (SMS) (Beta) only in compliance with all applicable laws and regulations, including telecommunications, consumer protection, marketing, and data protection laws. You are solely responsible for ensuring that all messages sent through Send Text (SMS) (Beta) comply with applicable consent requirements, including obtaining valid and verifiable consent from your recipients before sending messages, maintaining records demonstrating such consent, including appropriate mechanisms for recipients to opt out where required by law, or promptly honoring all opt-out requests.You shall not use it to send out unsolicited or unlawful messages, including without limitation (i) any harassment or abusive behaviours; (ii) fraud, phishing or deceptive messaging activities; (iii) spam or unsolicited bulk communications; (iv) distribution of malware or harmful content; or (v) any activity prohibited by telecommunications carriers

We rely on Twilio Ireland Limited, a company registered in the Republic of Ireland, whose registered address is 70 Sir John Rogerson’s Quay, Dublin 2, D02 R296 (Ireland) (“Twilio”) to provide this feature, and Twilio will act as our sub-processor. When using this feature you warrant and represent that you will comply with Twilio’s policies, as available here https://www.twilio.com/en-us/legal/aup and which are incorporated herein by reference, and that you shall at all times keep accurate and updated information in your account for purposes of registering you and your campaign with, and using Twilio’s services.

We may suspend or terminate Send Text (SMS) (Beta) at any time and without any liability to you for any damages, losses, or business interruption resulting from such suspension or termination if they determine that: (a) messaging activity violates Twilio’s policies or the agreements in place between TYPEFORM and you, (b) messaging traffic poses a risk to telecommunications networks, (c) regulatory requirements; (d) fraudulent or abusive traffic is detected; or (e) if we are required to do so if instructed by telecommunications providers.

Typeform does not operate a telecommunications infrastructure, nor controls the telecommunications carriers. Consequently, and considering that Typeform acts as technical intermediary only, you acknowledge and agree that delivery of SMS depends on external networks and providers outside our control, and that we may need to modify, suspend or discontinue any part of this feature at any time and without liability to you. We shall not be liable to you for any service interruption or limitation, or for delays in the delivery of any messages. Send Text (SMS) (Beta) is not covered by any service level agreement commitments, and we do not guarantee any uptime, message processing, delivery success or delivery success rates, or network availability. TYPEFORM disclaims all warranties on Send Text (SMS) (Beta), and this feature is provided “as is” and “as available”

You shall indemnify and hold TYPEFORM and its Associated Undertakings harmless from any Actions and Losses arising from (I) your use of Send Text (SMS) (Beta); (II) any breach of any applicable law or regulation, including failure to obtain proper consents, or use correct messaging content; (III) regulatory enforcement actions; and/or (IV) any claim by the recipients or any third party (including, without limitation, Twilio).
